Terms and Conditions of Sale
1) The Terms of Sale apply to the purchase of goods and services between the Buyer (hereinafter – the Consumer) and KS led ou (hereinafter – the Online Shop) from the online shop – KS led ou
2) In addition to these Terms and Conditions, legal relations arising from the purchase of goods from the Online Shop shall be governed by the Law on Obligations (hereinafter referred to as the STA), the Consumer Rights Protection Act (hereinafter referred to as the PTAS) and other applicable laws of the Republic of Estonia.
3) The online shop reserves the right to make changes to the terms of sale. These changes are reflected on the decolights.eu website.
Information on prices
1) All prices listed on decolights.eu are inclusive of VAT.
2) For purchases with a total amount of less than 99 euros for parcel delivery and less than 150 euros for delivery by courier, a delivery charge is added according to the delivery method chosen by the Consumer.
3) Prices are valid from the moment of placing the order until the end of the payment period of the completed order (1 day after placing the order).
4) If the order is created before the change of the sales conditions or prices, the legal relationship between the Consumer and decolights.eu shall be subject to the conditions in force at the time the order was placed.
5) The online shop reserves the right to make changes to the sale prices. These changes will be reflected on the website.
Delivery conditions
1) We offer several delivery options. You can choose the most suitable for your region. Prices may varie from different regions.
2) Delivery time 3-7 working days, in some cases delivery may take 10 working days.
3) Orders placed on weekdays and paid before 16:00 will be dispatched the same day. Estimated delivery time is 3-7 working days after dispatch. Orders placed on weekends and public holidays will be dispatched the next working day.
Placing an order
1) Add the desired products to your shopping basket.
2) To place an order, first click on the “Place an order” link in the shopping cart.
3) Then choose whether you want to place your order as a guest or as a regular customer (if the online shop has this option).
4) During the order process, fill in the required data fields, choose the delivery method that suits you and click on the “Place order” link. An invoice will appear on the screen, which you can conveniently pay using credit/debit card or local bank links for your region.
5) Please fill in the data fields carefully during order confirmation, as the accuracy and correctness of the information provided depends on the delivery time, accuracy
and the resolution of subsequent disputes and claims.
6) Payment is made outside the online shop in a secure environment – by using the bank link of the relevant bank in a secure environment. The Seller does not have access to the customer’s bank details.
7) Orders placed in the online shop from Monday to Friday, 9.00-16.00 shall be processed daily, while orders placed on Friday after 14.00 shall be processed on Monday.
8) KS led ou is the main processor of personal data, KS led ou transfers the personal data necessary for payment to the authorised data processor KEVIN.EU UAB.
Entry into force of the sales contract
1) By means of a contract of sale of goods, the Online Shop undertakes to transfer to the Consumer the existing, manufactured or future goods purchased by the Online Shop and to enable the transfer of ownership to the Consumer, and the Consumer undertakes to pay the Online Shop.
2) Orders that are not paid for will be cancelled 1 day after the order has been placed.
3) The contract of sale shall come into force after the Consumer has made the payment to the Internet Shop’s bank account.
Delivery
1) After the sales contract has entered into force, the online shop completes the order and transfers it to the company’s logistics partners for delivery.
2) The delivery terms specified on the Online Shop’s website are valid from the moment the order payment is received in the Online Shop’s bank account.
3) In order to ensure that the delivery is carried out without delay, care must be taken and true and valid data must be provided when entering the delivery details when placing an order.
4) The Online Shop shall not be liable for any delay in the delivery of the goods if the goods are handed over to the logistics partners on time but the delay in delivery is due to circumstances beyond the control or foreseeability of the Online Shop.
Right of return
1) Upon receipt of the order, the Consumer has the right to withdraw from the contract concluded with the Online Shop within 14 days without giving any reasons. A standard return request form will be sent by e-mail upon the Consumer’s request.
2) In the event of deterioration of the returned goods, the Consumer shall only be liable for the depreciation of the value of the goods resulting from the use of the item if he has used the item in a manner other than that necessary to ascertain the nature, characteristics and functioning of the item. In order to satisfy himself as to the quality, characteristics and functioning of the goods, the Consumer should act and use the goods only as he would normally be allowed to do in a shop.
3) To return an item, an application for withdrawal must be submitted – a form will be sent on request. And send it to [email protected] no later than 14 days after receipt of the goods.
4) The Consumer must return the goods within 14 days of the application or provide proof that he has handed over the goods to the logistics company within the aforementioned period.
5) The customer does not have to return the goods via the logistics company if the online shop has agreed to return the goods itself.
6) Upon receipt of the return request, the online shop shall immediately, but at the latest within 14 days, refund to the Consumer the amount paid by the Consumer under the contract, including the Consumer’s delivery costs, unless the Consumer has expressly chosen a delivery method other than the cheapest delivery method offered by the trader, the online shop shall not be obliged to refund to the Consumer the costs exceeding the costs of the normal delivery method.
Force majeure
1) The Online Shop shall not be liable for any damage or delay in delivery of the goods to the Buyer if the damage or delay in delivery of the goods is caused by circumstances beyond the control or foreseeability of the Online Shop.
Processing of personal data
1) By entering data in the online shop and with the appropriate confirmation, the Consumer authorises the collection and processing of the Consumer’s personal data (name, contact telephone number, parcel delivery and/or home address, email address) and their transfer to the delivery logistics partner.
2) The Online Shop has the right to use the Consumer’s home or location address to send advertising and other information to the Consumer.
3) The Consumer has the right to prohibit the collection and use of his personal data at any time, unless this is necessary for the enforcement of a claim arising from the contract or for the delivery of the goods.
4) The use of electronic personal data for direct mail only takes place if the Consumer has given a separate consent on the website.
5) When paying for purchases via encrypted data communication with banks, the Consumer ensures the security of personal bank IDs and the Online Shop does not have access to them.
Procedure for lodging complaints
1) The online shop shall be liable for non-conformity of the goods sold to the Consumer with the terms of the contract or for defects that appear within two years of delivery of the goods to the Consumer.
2) In the event of a defect, the Consumer shall have the right, at the latest within two months, to apply to the online shop by submitting the invoice on the basis of which the purchase of the goods was paid.
3) If the goods are defective, please stop using them.
4) The online shop and the Consumer agree on the repair or replacement of the defective goods. The cost of the repair shall be borne by the Online Shop.
5) The Online Shop shall not be liable for any defects in the goods caused by the Consumer and resulting from improper storage or use of the goods.
6) In case of product non-conformity or defects, please send a complaint to the e-mail address [email protected], indicating the Customer’s name, contact telephone number, order number and a precise description of the non-conformity or defect.
7) The complaint must be made within two months of the discovery of the non-conformity or defect.
8) All complaints will be investigated and the Consumer will be contacted as soon as possible, but no later than 14 days after receipt of the complaint.
9) The Consumer has the right to request a reduction in the purchase price or termination of the contract from the online shop and to recover money for the goods if the online shop cannot repair or replace the goods, if the repair or replacement fails or if the online shop fails to remedy the defect within a reasonable time.
Consumer’s right to turn to the Consumer Rights Protection Centre
1) If the Online Shop has refused to resolve the Consumer’s complaint or the Consumer does not agree with the solution offered by the Online Shop and finds that his rights or interests have been violated, the Consumer may lodge a complaint with the Consumer Complaints Centre. The Consumer may lodge a complaint himself or through a representative. Information about the Consumer Protection Commission can be found on the Consumer Council’s website, and for problems in EU Member States contact the European Consumer Centre.
